This End User License Agreement ("Agreement") is between you and Chromatik Games ("we," "us"). By installing or using any game or software published by us, you agree to these terms. Chromatik Games is operated as a sole proprietorship by Duane P. Smith Jr., based in North Carolina, USA.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the software for personal, non-commercial purposes on devices you own or control.

We may release updates, patches, or modifications to the software. Some updates may be required to continue using the software, particularly for online features.
If our games allow you to create or submit content (saves, replays, screenshots, names, etc.), you retain ownership but grant us a worldwide, royalty-free license to use, display, and distribute that content as necessary to operate our services.
This license terminates automatically if you violate these terms. Upon termination, you must cease using the software and delete all copies.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE. WE ARE NOT LIABLE FOR INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify and hold us harmless from any claims arising from your violation of this Agreement or your misuse of the software.
This Agreement is governed by the laws of the State of North Carolina, USA, without regard to conflict of law principles.
Any dispute arising under this EULA shall be resolved by binding arbitration in [YOUR COUNTY], North Carolina, conducted by the American Arbitration Association (AAA) under its consumer rules. You waive the right to a jury trial and to participate in a class action.
We may update this Agreement. Material changes will be communicated via the game and our website. Continued use after changes constitutes acceptance.
